To obtain interstate operating authority from the Federal Motor Carrier Safety Administration (FMCSA), you’ll need to follow a series of steps and meet specific requirements. Here’s a detailed guide to help you through the process:

Steps to Obtain Interstate Operating Authority

  1. Determine the Type of Authority Needed
    • Identify the type of interstate authority you need based on your business operations. Common types include:
      • Motor Carrier (MC) for transporting property or passengers
      • Broker authority for arranging transportation of property
      • Freight forwarder authority for consolidating shipments
  2. Register with the FMCSA
    • Unified Registration System (URS): All new applicants must use the URS to register. This system integrates various registration processes.
    • Visit the FMCSA URS website to start the registration process.
  3. Obtain a USDOT Number
    • Before applying for operating authority, you must have a USDOT number. This can be obtained through the URS during the registration process.
  4. Complete the OP-1 Application
    • Depending on your type of authority, complete the appropriate OP-1 application form:
      • OP-1: Motor Property Carrier and Broker Authority
      • OP-1(P): Motor Passenger Carrier Authority
      • OP-1(FF): Freight Forwarder Authority
    • This can also be done through the URS.
  5. Pay the Application Fee
    • The application fee is required and can be paid online via the FMCSA website. The fee varies depending on the type of authority:
      • $300 for each type of authority requested.
  6. File BOC-3 Form
    • Designate a process agent in each state you will operate. This is done by filing Form BOC-3 (Designation of Process Agents). You can find a list of companies that provide this service on the FMCSA website.
  7. Obtain Insurance
    • You must have adequate insurance coverage. The insurance requirements depend on the type of authority and the type of cargo or passengers being transported.
    • Common insurance forms include:
      • Form BMC-91 or BMC-91X for liability insurance
      • Form BMC-34 for cargo insurance
  8. Comply with Safety Regulations
    • Ensure compliance with FMCSA safety regulations, including vehicle maintenance, driver qualifications, hours of service, and drug and alcohol testing.
  9. Wait for the Operating Authority to be Granted
    • After submitting your application, paying fees, and meeting all requirements, the FMCSA will review your application. The process typically takes 20-25 business days.
    • Your operating authority will be granted when all requirements are met, and you will receive your MC number.
